JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.62/2024, registered for the offences under Sections 498-A, 323, 504, 506 and 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.M.R.Hiremathad, learned counsel appearing for the petitioners, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.R.Suresh, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves by filing a Memorandum of Settlement before the III Addl. Prl. Judge, Family Court at Bengaluru in M.C.No.7345/2025 and have filed a Joint Memo before this Court in that regard. The Joint Memo reads as follows: - 4 - HC-KAR NC: 2026:KHC:14458 CRL.P No. 6906 of 2024 <The Advocate for petitioners and respondent No.2 Respectfully submits as under. 1. It is submitted that the Petitioner No.1 and Respondent No.2 were legally wedded husband and wife and the marriage was solemnized on 16-04-2023 at Annapurneshwari Kalyana mantapa MG road Hassan. 2. It is submitted that, Petitioner no.2 & 3 are father and mother of Petitioner no.1 and petitioner No.4 being elder sister of Petitioner No.1. 3. It is further submitted that, The Respondent No.2 has left the matrimonial home on 07-02-2024 and filed Complaint before Bagalgunte Police Station and the same is registered under crime No.62/2024 for the offence punishable U/sec 323,498A,504, 506 & 34 of IPC R/w sec 3 & 4 of Dowry Prohibition act, after respondent no. 1 filing the chargesheet the case is converted into CC No. 21387/2024 which pending before 31st Addl Chief Judicial Magistrate Bengaluru and the petitioners have filed this above petition for quashing of proceedings in CC No. 21387/2024 pending before 31st Addl Chief Judicial Magistrate Bengaluru and this Hon'ble court has stayed the proceedings against the Petitioner no. 2 to 4 4. It is further submitted here that, panchayath was held between the well wishers of petitioner no.1 and respondent No.2 and as the petitioner no.1 and respondent no.2 agreed upon had filed Matrimonial Case for divorce by way of mutual consent before Family court judge Bengaluru in MC 7345/2025 and after the mediation, the case came to decreed and the marriage is dissolved between petitioner No.1 and Respondent No.2 on 7-01-2026 5. It is submitted that, order copy of memorandum of settlement and decree in MC 7345/2025 is enclosed here with for the kind perusal of this Hon'ble court, in which the Respondent no.2 has agreed to withdraw the complaint and criminal case pending before 31st Addl - 5 - HC-KAR NC: 2026:KHC:14458 CRL.P No. 6906 of 2024 Chief Judicial Magistrate Bengaluru in CC 21387/2024 filed against the petitioners and also ready to withdraw all the respective cases filed against the petitioners. 6. In view of above mentioned reasons, as the petitioner No.1 and respondent no.2 as agreed in the MC petition filed for divorce by way of mutual consent, and as agreed in the memorandum of settlement both the parties are ready to withdraw all the cases and allegation made against each other and the Respondent no.2 is ready to co-operate with to quash the Criminal proceedings pending before the 31st Addl chief judicial Magistrate Bengaluru in CC 21387/2024, Hence this Join memo= 4. The parties to the lis are present before the Court and would accept that the settlement has been arrived at by grant of mutual divorce and the terms of settlement have all been fulfilled. 5. In the light of filing of the Joint Memo and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. - 6 - HC-KAR NC: 2026:KHC:14458 CRL.P No. 6906 of 2024 ii.
