The petitioner is the mother. Her allegation is that the her son falsely represented that he has arranged for a loan and requested the petitioner to come to the Sub-Registrar office to execute a mortgage. Believing his son, she went to the Sub-Registrar Office and signed the document. However, subsequently she realised that it is a settlement deed. After that, in order to make the matter fait accompli, the son also further seems to have executed a mortgage deed only for a sum of Rs.10,000/-. Therefore, the above complaint was lodged and case in Crime No.270 of 2025 was registered for the alleged offences under Section 296(b), 351(3) and 318(4) of BNS. There is absolutely no action has been taken and hence, the petitioner is before this court. 3. When the matter came up for hearing, the learned Government Advocate (Criminal Side) would submit that the investigation in this case is complete and they have concluded that the case is a mistake of fact.
