WP No. 25501 of 2026 __________ Page2 of 5 Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of writ of Mandamus directing the first respondent to cancel the patta bearing No.7235 issued in the name of the fourth respondent by considering the petitioners representation dated 01.06.2026 and pass appropriate orders reviving the patta bearing No.1890 issued in favour of the petitioner Within a time frame to be fixed by this Court. For Petitioner(s): Mr.C.Munusamy For Respondent(s): Mr.B.Pachaiyappan, Government Counsel for R1 to R3 Order This Writ Petition has been filed to cancel the patta issued in the name of the fourth respondent by considering the petitioners representation dated 01.06.2026 and restore the patta issued in favour of the petitioner. 2. The learned counsel for the petitioners submitted that the petitioners purchased the property, measuring an extent of 21 cents, situated in S.F. Nos. 694/3, 711/3C, and 712/3A at Pennagaram Village and Taluk, Dharmapuri District. The revenue authorities had also issued a patta in the name of the petitioners, and they have since been in continuous possession and enjoyment of the property. The petitioners applied for a subdivision of the property through an online application dated 30.04.2024, following which the third respondent measured the land and installed boundary stones. WP No. 25501 of 2026 __________ Page3 of 5 surprise of the petitioners, the third respondent subsequently transferred the patta to the name of the fourth respondent, who has no connection whatsoever to the subject property, without issuing any prior notice to the petitioners or conducting an enquiry.
Consequently, the petitioners submitted a representation dated 01.06.2026 to the authorities concerned, including the official respondents, seeking to cancel the patta issued in favour of the fourth respondent and to restore the names of the petitioners in the revenue records. Since the said representation has not been considered, the petitioners have approached this Court by way of the present writ petition. 3. In reply, Mr.B.Pachaiyappan, learned Government Counsel who takes notice on behalf of the respondents would submit that the petitioner’s representation dated 01.06.2026 will be disposed of by the respondents within a period of eight weeks. 4. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record. 5. In view of the above, this Court directs the first respondent to consider the petitioners’ representation dated 01.06.2026 on its own merits and dispose of the same in accordance with law within a period of eight (8) weeks from the https://www.mhc.tn.gov.in/judis
