2. It is the case of the prosecution that the petitioner attacked the defacto complainant, who is none other than his father, using his hands and legs, thereby causing his death. Hence, the case. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 07.10.2025 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail. 4. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, produced the report received from the Institute of Mental Health, Kilpauk, Chennai, pursuant to the order passed by this Court on 07.07.2026 directing the Prison authorities to obtain a report regarding the present medical/mental condition of the petitioner. As per the said report, the petitioner was diagnosed with "Substance-Induced Psychosis with Borderline Intelligence", was discharged on 28.10.2025 and was advised to continue medication on an outpatient basis at the nearby Government Hospital. 2/6 https://www.mhc.tn.gov.in/judis

Considering the above factual position, this Court finds that the occurrence took place on 07.10.2025 and that prima facily there was no apparent motive for the alleged offence and that the unfortunate incident appears to have occurred on account of the petitioner's substance induced mental condition. This Court has also perused the report submitted by the Medical Officer, Institute of Mental Health, Kilpauk, Chennai.
Therefore, considering the petitioner's mental health condition, the long period of incarceration undergone by him, the fact that he has no bad antecedents, and also the fact that a major portion of the investigation has already been completed, this Court is inclined to enlarge the petitioner on bail, subject to certain conditions. The petitioner is further directed to continue his treatment at the nearby Government Hospital and adhere to the medical advice prescribed by the treating doctors. 6. Accordingly, the petitioner is ordered to be released on bail on their executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sriperumbudur and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. Crl.O.P.No.17289 of 2026 [b] the petitioner shall report before the respondent police everyday at 10.30 a.m. for a period of two weeks and thereafter as and when required for interrogation; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023. 13.07.2026 skr Note:
