Metropolitan Magistrate, FTC-II, Egmore @ Allikulam Chennai and to complying the conditions imposed by the Honourable Court in Crl.MP.No.6159 of 2026 in Crl.RC.No.785 of 2026 order dated 08.04.2026 and thus render justice. 2. CRL MP No. 10635 of 2026 has been filed by the petitioner to modify a conditional No.5(1) order imposed in Crl.MP.No.6159 of 2026 in Crl.RC.No.785 of 2026 order dated 08.04.2026. 3. Mr.Manoj Kumar, learned counsel for the respondent submits that this Court has imposed a condition on the petitioner in para No.5(i) of the order dated 08.04.2026 directed him to deposit a sum of Rs.50% of the cheque amount before the trial Court within the stipulated time as fixed by this Court. However, till date, the petitioner has not complied with the said condition and he is enjoying the fruit of the order dated 08.04.2026. Thus, the respondent has moved an application to recall the order of suspension of sentence passed by this Court dated 08.04.2026. The learned counsel for the petitioner submits that due to some financial crisis, the petitioner is not able to comply with the condition No.5(i) of the order passed by this Court dated 08.04.2026. He further submitted that now the fund has been arranged and his client is ready to make compliance of the order passed by this Court. 5. Accordingly, considering the request made by the learned counsel for the petitioner, time is extended by 10 days from today and no more further time is allowed to comply with the condition 5(i) of the order passed by this Court. In this regard, the petitioner is directed to produce deposit receipt on the next date of hearing before this Court. In case of failure to comply with the condition imposed by this Court dated 08.04.2026, the case will be finally decided on the next date fixed. 6. Accordingly, Crl.MP.No.10634 of 2026 is ordered and Crl.MP.No.10635 of 2026 is dismissed. 7.
