B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH
ORDER 24.04.2026
Heard Mr. M Talukdar, the learned counsel appearing on behalf of the applicants. 2. This is an application filed by the applicants, who were the respondent Nos.1, 2, 3 and 4 in MAC Appeal No.236/2025. 3. The grievance of the applicants herein is that though in the Memo of Appeal, the respondent Nos.2 and 3, who are the applicant Nos.2 and 3 herein have been shown as sons of Lt.
Mustafa Ali, but in the certified copy which was issued, the applicant Nos.2 & 3/respondent Nos.2 and 3 in the appeal has been shown as the wife of Lt. Mustafa Ali. 4. It is the opinion of this Court that the mistake was committed by the Registry at the time of inserting the name in the CIS and as such, on account of such mistakes committed by the Registry, the respondents/applicants herein ought not to suffer. 5. This Court also takes note of that originally the address of the respondent
Page No.# 4/4 Nos.1 to 5 were mentioned in the Memo of Appeal as having the same address. This Court struck off the respondent No.5. But it appears that the Registry of this Court while striking out the respondent No.5 also struck off the address of the respondent Nos.1 to 4. Under such circumstances, it is noticed that the respondent Nos.1 to 4 is shown without any address. This is also another fault on the part of the Registry thereby resulting in absence of the address of the respondent Nos.1, 2, 3 and 4. 6. Accordingly, this Court directs the Registry to correct the data in the CIS in terms with the memo of appeal. The Registry shall also insert in the CIS the address of the respondent Nos.1, 2, 3 and 4 which is also mentioned in the memo of appeal and thereupon provide a certified copy of the order. 7. Interlocutory application, accordingly, stands disposed of. JUDGE Comparing Assistant
