Complaining illegal construction at the behest of the respondent nos. 6 and 7 at L R Plot nos. 3 and 4 at Mouza Nischindiput, J.L. No. 31, P.S. Ghatal, Ward no. 5, Paschim Medinipur and failure on the part of the municipal authorities to take steps, the instant writ petition has been filed. 3. The municipality is represented and submits that there is a sanctioned building plan and the construction carried out by the private respondent nos. 6 and 7 is in accordance with the sanctioned building plan. The confusion created by the response filed under the Right To Information Act has since been clarified by the municipal authorities by a communication dated 9th April 2025 issued by the Chairman of Ghatal Municipality which was addressed to the petitioner’s learned advocate. Notwithstanding the aforesaid, the instant writ petition has been filed. 2 4. Having heard the learned advocates appearing for the respective parties and noting that the writ petition has been filed on 3rd April 2025 on the basis of the response to RTI application dated 7th February 2025, I am of the view that writ petition was obviously filed without notice of the communication / clarification dated 9th April 2025. 5. In view thereof, the writ petition stands dismissed without any order as to costs. 6. All parties shall act on the basis of server copy of this order duly downloaded from this Court’s official website. (Raja Basu Chowdhury, J.)
