JUSTICE SAMEER JAIN Order 06/03/2026 1. The instant bail applications have been filed under Section 483 of BNSS on behalf of accused-applicants. The accused- [2026:RJ-JP:9796] (2 of 3) [CRLMB-2538/2026] applicants were arrested in connection with FIR No.37/2026 registered at Police Station Chandwaji, District Jaipur Rural for the offence(s) under Sections 8/21 of NDPS Act. 2. Learned counsel for the applicants have undertaken that except for applicant-Ashish Sharma qua whom two criminal antecedents under Section 498A/406 of IPC and under Section 13 of Rajasthan Public Gambling Ordinance, 1949 (RPGO) are registered, no other applicants have any criminal antecedents registered against them. It is submitted that quantity recovered of smack is much lesser than commercial quantity i.e. 43 gms. and that there is also recovery of Rs. 1700/-, and that the applicants were in close company of each other. It is also submitted that the applicants are in custody since 29.01.2026. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. 4. Considering the arguments advanced by the counsel for the parties, considering that the recovered contraband is less than the commercial quantity; that the applicants are in custody since 29.01.2026; that the applicants are all below the age of 28 years, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicants and enlarge them on bail. 5. Accordingly, the bail application under Section 483 of BNSS is allowed and it is ordered that accused-applicants Sushri Suruchi Singh D/o Hari Bhushan, Kishan Sharma S/o Rambabu Sharma, Ashish Sharma S/o Girraj Sharma, each shall be enlarged on bail provided she furnishes a personal bond [2026:RJ-JP:9796] (3 of 3) [CRLMB-2538/2026] of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
