ORAL ORDER
Revision petitioner has tendered cash in a sum of Rs.50,000/- to the learned counsel for the respondent. Same is acknowledged in the order sheet. The said amount to be deposited into the account of the Agricultural Producers Marketing Society, Halekote, Belthangady Taluk i.e., the complainant.
2. Joint memo is filed by the learned counsel for the parties, which reads as under: <Undersigned counsel for the petitioner hereby submits that, the petitioner has paid 50% of the fine amount of Rs.90,000/- (ninety thousand only) by virtue of order dated 14.01.2019 passed by this Hon9ble Court. Now the petitioner has paid sum of Rs.50,000/- (fifty thousand rupees only) by the way of cash to the respondent and further petitioner undertakes that, remaining balance amount of Rs.68,466/- will be paid within a period of 2 months. Hence in this petition, sought to allow the petitioner and the petitioner may be acquitted in the interest of justice. Hence this memo.=

Learned counsel for the respondent/complainant has endorsed 8no objection9 on the memo.
4. Placing the memo on record, revision petition stands
disposed of.
5. The amount in deposit, if any, is ordered to be withdrawn by the complainant under due identification.
6. It is made clear that, if the amount as agreed in the memo is not paid, revision petitioner shall undergo imprisonment as ordered by the learned Trial Magistrate confirmed by the learned Judge in the First Appellate Court.
