Sandhawalia , Chief Justice (Oral) Challenge has been raised to withholding the tender process by the State and directions were 1 Whether the reporters of Local Papers may be allowed to see the judgment? 2 sought to take the e-tender to its logical end and and award the same to L-1 bidder. 2. On 06.10.2025, we had made the following observations:- “Inter-alia contends that e-tender for providing cooked diet services to the Pt. Jawahar Lal Nehru Government College & Hospital, Chamba was invited in June, 2025, but the same has not been finalized. Representation sent as such was also responded to on 08.08.2025 (Annexure P-10) that the financial bid had been opened and tender has not been cancelled. It is the contention of the learned Senior Counsel that respondent No. 6 as such has continued to give his services for the said purpose in spite of the fact that the tender was called for on enhancement of the price and that the said procedure had earlier also been followed. Reference has also been made to the response to the legal notice dated 17.09.2025 (Annexure P-13) that the 3 private respondent himself has made some complaint regarding discrepancies in Technical Evaluation, due to which finalization of tender process has not been done. Issue notice. Mr. Pranay Pratap Singh, learned Additional Advocate General, accepts notice for respondents No. 1 to 5. Notice be issued to respondent No. 6, returnable by the next date, on taking steps during the course of the day. Dasti permitted. List on 04.11.2025. Needless to say that pendency of the present writ petition will not stop the official respondent to take a call on the merits of the case for the finalization of the tender process, keeping in view the observations made herein above.” 3. Today, we are informed that the tender has now been awarded to the L-1 bidder, i.e. M/s Bharat Cuisine Services Chefs & Caterers and others, which would be clear from the communication dated 31.12.2025. 4 4. Resultantly, we are of the considered opinion that the present writ petition has been rendered infructuous in view of the affirmative action. 5. Needless to say that we have not commented upon the rights of private respondent No.6. 6. Pending application(s), if any, also stands disposed of. (G.S. Sandhawalia) Chief Justice.
