ORAL ORDER
The petitioners are before this Court calling in question the proceedings in C.C.No.26685/2023, pending before the 41st A.C.M.M, at Bengaluru, registered for the offences under Sections 498A and 325 read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
2. Heard Sri.Manjunath M.R.,
learned counsel appearing for the petitioners, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.Venkateshaiah S.E.,
learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo to that effect. The Joint Memo reads as follows:

we state that the 2nd respondent filed complaint against the petitioners and accused No.1 alleged that on 21/04/2019 the Accused No.1 married to Respondent No.2 at Vasavi Kalyana Mantapa, Kudur, Magadi Taluk, Ramanagara District It is alleged in the complaint that That on 06/10/2023 the station house in- charge of 1st Respondent Police have registered a case in Crime No.89/2023 for an offences punishable under section 498(A), 325, of IPC and section 3 and 4 of DP Act in CC.No.26685/2023 of Amruthalli Police Station, Bangalore pending on the file of the XLI ACJM Bangalore, against the petitioners alleging that after her marriage the 1st accused and the petitioners started harassing her physically and mentally by demanding more dowry and sent her out of their family later she stayed her parental house for a period of 2 months later the family of petitioners advised her get her back as per her demand the 1st accused made separate rent house at Jakkur while she asked about his job when she became 7th month conceive she went to her parents' house on 12/08/2020 she gave birth to girl child the petitioner ever went to see her child and ever come to take her to matrimonial home she stayed 2 years in her parents' house in the year 2022 the 1st accused taken her back rent house at HBR Layout they stayed 4 months together there also the 1st accused continued his attitude by abusing and assaulted the 2nd respondent lodged compliant against the 1st accused on 20/01/2023 at Amruthalli Police in their NCR No. 72/2023 but the 1st accused not taken her back that on 05/02/2023 at about 8-30 PM the 2nd respondent went to ask about 1st accused to house of petitioners they started quarrel with her by abusing and pushed her she got injury on her right leg she called her sister went back due to leg injury she took treatment but still two months her leg pain not down she further alleged that on 04/04/2023 she went to Bowring hospital about her leg pain the doctor of hospital informed her she need surgery about fracture based on the said complaint the 1st respondent registered a case against the petitioners aggrieved by the same, the petitioners have filed petition for quashing of the said proceedings.
3. we submits that the 2nd respondent lodged complaint against the petitioners and accused No.1 with

misconception of facts, hence the 2nd respondent entered in to compromise before the elders of the family and well- wishers not to proceed the criminal case each other in MC.No.1018/2023 filed by the 1st accused against the 2nd respondent appeared before the Mediation on 17/02/2026 and they reunion with their daughters subject to deposit 2,00,000/- in the name of their minor daughter Apsara and Rs.1,00,000/- in the name 2nd respondent with free will and consent and there was no force or threat each other, since then they are residing together with their child happily. 4. we submits that in terms of the settlement arrived between the parties the respondent No.2 has agreed to quash the proceedings pending in CC.No.26685/2023, for an offences punishable under sections 498(A), 325, of IPC and section 3 and 4 of Dowry Prohibition act-1961 of Amruthahalli Police Station, Bangalore pending on the file of the XLI ACJM Bangalore. 5. we submits that there has been no collusion or force fraud or any undue influence entering into this compromise in the aforesaid manner similarly both the parties have no future claims each other. 6. we submits that the parties have affixed their signatures with their free consent without having any misrepresentation, fraud and undue influence. Wherefore we prayed before this Hon'ble court be pleased to quash the entire proceedings in CC.No.26685/2023, for an offences punishable under sections 498(A), 325, of IPC and section 3 and 4 of of Dowry Prohibition act-1961 of Amruthahalli Police Station, Bangalore pending on the file of the XLI ACJM Bangalore, against the petitioners in the ends of justice.=
4. The parties to the lis are present before the Court and are identified by their respective counsels. - 6 -

5. In the light of Joint Memo being filed and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.26685/2023 pending before 41st A.C.M.M., Bengaluru, stands quashed qua the petitioners.
