Mr. Shiv Shankar Banerjee, Mr. Abhishek Chakraborty ….for the ECL. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Husband of the petitioner died-in-harness on 7th October, 2005. 3. Petitioner applied for appointment on compassionate ground but same could not be considered. Thereafter petitioner made an application for release of Monthly Monetary Cash Compensation (for short “MMCC”) in view of untimely death of her husband. Petitioner prays for direction for payment of MMCC along with arrears and interest. 4. Reliance is placed on the judgment dated 20th May, 2025 of a coordinate Bench passed on a writ petition being WPA 33 of 2025 (Maya Bouri v. M/s. Eastern Coalfields Limited & Ors.). 5. Learned advocate representing Eastern Coalfields Limited has submitted that once an application is made seeking payment towards MMCC steps are required to be taken in accordance with law for release of such benefits. 6. Having considered the respective submissions made on behalf of the parties and taking note of the fact that an application has been made by the petitioner seeking MMCC on 23rd July, 2025 General Manager, Eastern Coalfields Limited, Satgram-Sripur Area, Paschim Bardhaman being respondent no.5 is directed to release MMCC benefits to the petitioner in consideration of her application dated 23rd July, 2025 by four weeks from the date of communication of this order. 7. While releasing such benefits respondent no.5 shall follow the observations and directions as contained in Maya Bouri (supra). 8. The writ petition stands disposed of. 9. There shall be no order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
