The present bail application has been filed under Section 482 BNSS in connection with FIR No. 329/2025 registered at Police Station Ghatoli District Jhalawar for the offence(s) under Sections 8/21, 25, 29 of NDPS Act and the learned Trial Court amidst the offences under Section 8/29 of NDPS Act dismissed the bail application before it. 2. Learned counsel for the applicant has submitted that the applicant is a married lady, aged approximately 35 years, and that she has to take care her family; and that she has no criminal antecedents registered against her. It is submitted that she is booked under Section 8/29 of NDPS Act merely on the oral statement and call details, of co-accused, who is neighbor. It is further submitted that the quantity of contraband recovered (i.e. smack) is 200 gm, which is less than the commercial quantity i.e. [2026:RJ-JP:12811] (2 of 3) [CRLMB-16761/2025] 250 gm. It is lastly submitted that the applicant is ready to abide by the conditions, if imposed and she may be granted protection from the arrest. 3. Per contra, learned Public Prosecutor has vehemently opposed the present bail application. 4. Having heard the contentions made by the counsel representing both the parties, upon a perusal of the material available on record and taking note of the fact that the applicant is a married lady, aged 35 years, who has to take care her family; that there are no criminal antecedents registered against her; that she is booked under Section 8/29 of NDPS Act merely on the oral statement of co-accused; that the quantity of contraband recovered is less than the commercial quantity, this Court is inclined to allow the anticipatory bail application. 5. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Ghatoli, District Jhalawar in F.I.R. No. 329/2025 is directed that in the event of arrest of the accused-applicant Mangi Bai W/o Ranglal, she shall be released on bail, provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station. Withal, following conditions are also imposed upon the applicant:- (i) that the applicant shall make herself available for interrogation by a police officer as and when required; (ii) that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the court or any police officer, and [2026:RJ-JP:12811] (3 of 3) [CRLMB-16761/2025] (iii) that the applicant shall not leave India without previous permission of the court.
