Laskar for the applicant, Abdul Mannan Laskar who has filed this application under Section 438 of the BNSS, 2023 with prayer for suspension of sentence in the impugned judgment and order dated 05.03.2026 passed by the learned Special Judge, Cachar in Special POCSO Case No. 187/2024, convicting the applicant under Section 363 of the IPC and sentencing him to undergo rigorous imprisonment for 2 years and to pay a fine of Rs. 5,000/- with default stipulation. Issue notice to the respondent No. 2 returnable within 4 (four) weeks. Learned Additional Public Prosecutor, Mr. B. Sharma is present for the respondent No. 1 and has accepted notice and thus no formal notice is required to be issued. Learned Additional Public Prosecutor has no objection. The petitioner has also prayed to remain on previous bail. I have considered the submissions at the Bar with circumspection. The operation of the judgment and order dated 05.03.2026 in Special POCSO Case No. 187/2024 is hereby stayed until further orders and he is also allowed to remain on previous bail until further orders.
