SIDE) ORDER When the matter is taken up for hearing, the learned counsel for the petitioner submitted that the petitioner, who is owner of Mahendra Tourister white colour bearing Registration No.TN-25CF-2337, filed this petition seeking modification of the order dated 27.01.2026 in Criminal Revision Petition No.28 of 2025, wherein, in paragraph 10 (iii) a condition was imposed directing the petitioner to produce the original RC, FC before the District Munsif cum Judicial Magistrate, Gummidipoondi. Since the vehicle was seized and detained by the respondent police, the vehicle could not be produced for obtaining fitness certificate. Hence, fitness certificate has not obtained and the petitioner is unable to produce the same. The petitioner is in possession of RC and ready to produce the same. After the vehicle is returned to the petitioner, the petitioner undertakes to obtain fitness certificate and produce the same. 2.In view of the above submissions, the condition imposed in paragraph 10(iii) is modified to the effect that the petitioner to produce the original RC before the trial Court and on such production, the trial Court is directed to return https://www.mhc.tn.gov.in/judis CRL MP No. 10700 of 2026 __________ Page3 of 4 the vehicle to the petitioner without insisting upon the fitness certificate. The petitioner to produce Fitness Certificate before the trial court after obtaining the same. 3.Accordingly, this criminal miscellaneous petition is ordered.
