CRL OP No. 18006 of 2026 __________ Page3 of 6 perused the materials available on record. 6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); though the case has been registered for the offence of aggravated penetrative sexual assault, the petitioner was remanded in judicial custody since 17.11.2025. On a perusal of the statement recorded under Section 183 of BNSS, this Court is unable to find any material to prima facie attract the offence of aggravated penetrative sexual assault. Though certain serious allegations have been made against the petitioner, considering the period of long incarceration and the charge sheet has also been filed, this Court is of the firm view that the further custodial interrogation of the petitioner is not required for the purpose of investigation. Hence, this Court is inclined to grant bail to the petitioner, subject to certain conditions. 7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Special Court for Exclusive Trial of cases under POCSO Act, Tiruvannamalai, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety slip https://www.mhc.tn.gov.in/judis
