Heard the learned counsel for the petitioner. 3. Noting that in spite of service of notice, there was no appearance on the side of the respondent/ Judgement Debtor in an application filed for a direction to the Judgement Debtor to file its affidavit of assets and other means. This Court had directed the numbering of the Execution Petition. Apart from it, a direction was also issued under the same order directing the respondent to deposit a sum of Rs.23,42,295/- (Rupees Twenty Three Lakhs, Forty Two Thousand, Two Hundred and Ninety Five only) and issue a further notice in the Execution Petition. Thereafter, substituted service had also been effected through paper publication. It is to be noted that a counsel had entered appearance and the Vakalath filed by the counsel had been returned as early as on 25.11.2025. 4. As noted above, the direction issued by this Court for a deposit of sum of Rs.23,42,295/- (Rupees Twenty Three Lakhs, Forty Two Thousand, Two Hundred and Ninety Five only) had not been complied with and the fact that the Vakalath had been filed and returned in the month of November 2025 would make it imperative that the respondent had been put on notice on the present Execution Proceedings, in spite of which the respondent had kept away from the https://www.mhc.tn.gov.in/judis EP No. 9 of 2026 __________ Page3 of 4 judicial proceedings which in view of the Court is to deter the petitioner from recovering the amount under the Award. In such view of the matter, this Court finds no impediment in allowing the Execution Petition as prayed for. 5. As a sequel, the petitioner is directed to deposit a sum of Rs.30,000/- (Rupees Thirty Thousand only) towards the expenses for execution of this order. On such deposit, a warrant shall be issued to secure the Judgement Debtor for him to be detained in civil prison for a period of one month. 6. Accordingly, the present Execution Petition stands ordered as prayed for.
