The learned counsel for the petitioner submitted that the property situated at Old T.S. No. 3076, New T.S. No. 120/1, Old Ward No. 7, New Ward No. 21, measuring an extent of 396 sq. ft., Sokkampudur Road, Gopal Layout (Ponnaiyarajapuram), Komarapalayam Village, Coimbatore District, was acquired by the petitioner’s father through a registered partition deed. Subsequently, the petitioner’s father executed a registered will dated 27.03.1998, bequeathing the said property in favour of the petitioner and his brother. The petitioner has since been in continuous possession and enjoyment of the property. Following the sale of a portion of the land, the petitioner submitted an application dated 21.01.2026 to the land surveyor to measure and demarcate its four boundaries. Since the said application has not been considered, the petitioner has approached this Court by way of the present writ petition. 3. Mr.B.Pachaiyappan, learned Government’s Counsel, who accepts notice on behalf of the respondent would submit that the petitioner’s land will be surveyed and demarcated based on his application dated 21.01.2026, within a time frame to be fixed by this Court. 4. Heard the learned counsel for the petitioner as well as the learned Government’s Counsel appearing for the respondent. https://www.mhc.tn.gov.in/judis WP No. 25122 of 2026 __________ Page3 of 5 5.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondent to consider the petitioner’s application dated 21.01.2026 and conduct a survey and demarcate the subject properties, within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned. If any need arises for Police assistance, it is open to the respondent to request for Police protection from the jurisdictional Police. If any such request is made, the jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 6.In the event of any dispute regarding possession, the respondents shall not adjudicate upon the question of title. The petitioner and the concerned parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law.
