No. 1181 of 2026 Prayer: Petition filed under Article 226 of the Constitution of India, praying for issue a Writ of Mandamus, (1) directing the second respondent -Additional Director General of Police, CBCID , Chennai -to entrust the matter to an officer not below the rank of Superintendent of Police for conducting a full, fair and impartial investigation into the fraudulent inclusion of 47 excess ballot papers in the Bar Council of Tamil Nadu and Puducherry elections held on 23.03.2026 at Booth No. 89, Tiruppur Combined Courts, and to initiate appropriate criminal proceedings so as to bring out the culprits before the law and punish them in accordance with Criminal justice; (2) to issue consequential directions to the first and third respondents - Director General of Police, Chennai and Commissioner of Police, Tiruppur- to extend all necessary assistance, protection, etc. For Petitioner(s): Mr.A.Vidyasagar (Through Video Conferencing) For Respondent(s): Mr.C.R.Malarvannan Counsel for Government of Tamil Nadu (Crl. This Writ Petition is filed seeking a Mandamus, directing the Additional Director General of Police, CBCID/R1 to entrust the grievances of the petitioner to an officer not below the rank of Superintendent of Police for a fair and impartial investigation. The grievances relate to alleged fraudulent inclusion of 47 excess ballot papers in Booth No. 89, Tiruppur Combined Courts in connection with the elections relating to the Bar Council of Tamil Nadu and Puducherry held on 23.03.2026. The petitioner also seeks initiation of criminal proceedings assuming that the investigation reveals the necessity for the same.

We have heard Mr.A.Vidyasagar, learned counsel for petitioner, Mr.C.R.Malarvannan, learned Government Counsel for R1 to R3 and Mr.Chandrasekar, learned counsel for R4, Secretary of the Bar Council of Tamil Nadu and Puducherry. 3. Mr.Chandrasekar circulates an order passed by the Supreme Court on 18.11.2025 in M.Varadhan Vs. Union of India & another and batch1, setting out a slew of directions in relation to the procedure to be followed in addressing grievances in the conduct of elections by the State Bar Council. Since the subject was pan India in nature and application, and bearing in mind that the thrust of the matter related to the holding of timely elections for State Bar Councils, the Supreme Court constituted a High-Powered Election Committee in all States. 4. As far as the States of Tamil Nadu and Kerala are concerned, the Committee is chaired by Justice Rajiv Shakdher, who has nominated Mr.E.Om Prakash, Senior Advocate and Dr.Amit George, Advocate as Members (‘State High Powered Election Committee)’. The order of the Hon’ble Supreme Court sets out an in-built mechanism for resolution of grievances relating to conduct of the elections by the State Bar Council as follows: i) Any individual having a grievance relating to the election may make a representation before the State High Powered Election Committee. ii)If aggrieved by the decision of the High-Powered Election Committee, 1 Writ Petition(s) (Civil) No(s).1319/2023 dated 18.11.2025 __________ Page3 of 6 https://www.mhc.tn.gov.in/judis

No. 1181 of 2026 the individual may approach the High-Powered Supervisory Committee chaired by Justice Sudhanshu Dhulia, former Judge of Supreme Court of India, Justice Ravi Shankar Jha, former Chief Justice of Punjab and Haryana High Court and Mr.V.Giri, Senior Advocate. 5. At paragraph 20 of order dated 18.11.2025, the Bench categorically states that the decision taken by the High Powered Supervisory Committee shall be final and no civil court or High Court shall entertain any petition(s) against their decision. 6.
We thus of the considered view that the present Writ Petition is not maintainable, and it was for the petitioner to follow the process as adumbrated above. Incidentally, in the compilation of documents annexed to the affidavit, we find that a petition was addressed to the Returning Officer for the elections to the Bar Council of Tamil Nadu and Puducherry and we also find that the Returning Officer has passed an order on the representation of the petitioner. 7. In light of the discussion as above, this Writ Petition is dismissed as not maintainable. (A.S.M.,J.)
