…For the State
Petitioners seek anticipatory bail. Claim is on account of parity with other co-accused who were enlarged on bail by the Coordinate Bench in C.R.M. (A) 3004 of 2026 dated September 22, 2026. State opposes the prayer for grant of anticipatory bail. Learned advocate appearing for the State draws the attention of the Court to the post mortem report of the victim. She also draws the attention of the Court to the various other materials in the case diary.
2 Petitioner before Court is the father-in-law and the brother-in-law of the victim. The death of the victim occurred on the land adjoining the matrimonial home. Neighbours implicated both the petitioners in meting out torture to the victim. Materials in the case diary apparently do not support the claim for parity of the petitioners with the co-accused who were granted anticipatory bail by the Coordinate Bench. Post mortem report of the victim shows that apart from anti-mortem hanging, there was evidence of physical assault on the victim. In such circumstances, I am not minded to grant anticipatory bail to the petitioner and the prayer for anticipatory bail of the petitioners is rejected. The application being C.R.M. (A) 3413 of 2026 stands dismissed.
