IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION
WPA 5987 of 2026
Daibaki Bauri Vs. The State of West Bengal & Ors.
Mr. Pratip Kumar Chatterjee, Sr. Adv. Ms. Maitrayee Chatterjee … for the Petitioner. Ms. Debjani Ghoshal Ms. Koushikee Banerjee … for the State.
1. The petitioner’s application seeking compassionate appointment forwarded by the University to the Director of Public Instruction (hereinafter referred to as ‘DPI’) way back on January 5, 2023 is alleged to be kept pending.
2. The husband of the petitioner was serving as Laboratory Attendant in the University. He died-in- harness on January 22, 2022.
3. Despite forwarding the request of the petitioner for compassionate appointment to the DPI by the University, no response has been made by the DPI.
4. Prayer has been made to direct DPI to dispose of the application of the petitioner.
5. As it appears that the prayer of the petitioner is pending consideration before the DPI, no useful purpose will be served by keeping the writ petition pending.
6. Accordingly, the instant writ petition stands
disposed of by directing the DPI to take a decision on
2 the petitioner’s prayer for grant of compassionate appointment strictly in accordance with law at the earliest, but positively within a period of eight weeks from the date of communication of this order.
7. A reasoned
order shall be passed and communicated to the petitioner.
8. If the claim of the petitioner is allowed, then prompt necessary step shall be taken in furtherance thereto.
9. Learned advocate for the petitioner is directed to forward copy of all documents to the DPI in support of her claim at the time of communicating the order of the Court.
10. The writ petition stands disposed of.
11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
12. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
