This Application has been filed for quashing the impugned order dated 16.12.2025, passed by learned City Magistrate, Dehradun in Case No.20 of 2025, “State vs. Micky Singh & Others”, under Section 164 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, “Sanhita, 2023”). 2 . Mr. Piyush Garg, learned counsel for the applicant. 3 . Mr. Pratiroop Pandey, learned Assistant Government Advocate for the respondent no.1. 4 . Mr. Piyush Garg, Advocate contended that learned City Magistrate, District Dehradun has not stated the grounds for his satisfaction before issuing notice to the applicant under Section 164 of the Sanhita, 2023 and the City Magistrate, having exceeded his jurisdiction, directed the parties to maintain status quo at the spot. Therefore, the applicant has filed objection before the City Magistrate, District Dehradun challenging the maintainability of the proceedings, which is still pending. 6 . Mr. Pratiroop Pandey, Assistant Government Advocate, on instructions, has sought three weeks’ time for deciding the objection, filed by the applicant. 7 . Having heard. The impugned order passed in relation to the status quo is set aside.
