This petition has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs :- “10.1 That this Hon'ble Court may kindly be pleased to call for entire records pertaining to the case of the petitioner for kind perusal of this Hon'ble Court. 10.2 That this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to restrain making the construction of government houses on the same land bearing khasra No.5/1 of Gram Panchayat Piparda of Janpad Panchayat Bamhanidih. 10.3 That this Hon'ble Court may kindly be pleased to direct the respondents authority to give compensation in lieu of cutting paddy crops forcefully by the private respondents or direct to the private respondents under what provision of law forcefully cutting down the paddy crops of the petitioner. 10.4 That this Hon'ble Court may kindly be pleased to direct the respondents authority to 4 register the name of the petitioner in Revenue Record because after lapse of 30 years in possession of government land it has been extinguished by the Government and it ought to be recorded in Revenue Records in the name of petitioner. 10.5 Any other relief, which may be deemed, fit by this Hon'ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner is in possession over the Government land bearing Khasra No.5/1, admeasuring 4 acres since the time of his forefathers, situated at Village Bhanwarmal, Tahsil Bamhnidih, District Janjgir-Champa (CG). The petitioner has been sowing paddy crops on the aforesaid land since many years. He had also sown same crop in the year 2025 as well but the same has been illegally harvested by private respondents No.5 to 31. He further submits that the petitioner has perfected his title over the said land by way of adverse possession, despite that the private respondents have illegally harvested the crops. He next submits that the complaint has been made by the petitioner before the respondent authorities, but no action has been taken by them against the private respondents No.5 to 31. Hence, learned counsel prays that the petition may be admitted for hearing. 3. Per contra, learned counsel for the State/respondents No.1 to 4 submits that the petitioner is claiming his right over the aforesaid land on the basis of adverse possession. Therefore, if the petitioner has any grievance, he may file civil suit. 4. I have heard learned counsel for the parties and perused the material 5 available on record. 5. From the manner in which the pleadings have been drafted, it is evident that the petitioner is claiming his possessory right on the basis of principle of adverse possession. He has further alleged that paddy crops sowed by him on the said government land were illegally harvested by private respondents and thereby causing him financial loss. Perusal of aforesaid facts shows that the land in question is a government land. If the petitioner claims possessory right and alleges monetary loss caused to him, it is a matter of dispute, which can be considered and decided after taking evidence. The Writ Court is not a fact-finding Court. Hence, I am not inclined to entertain the instant petition. The petitioner is at liberty to approach the Civil Court for redressal of his grievance. 6.
