REPRESENTED BY ITS MEMBER SECRETARY. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of a Writ of MANDAMUS, declaring the action of Respondent Nos.1 to 5 in failing to implement the statutory approvals granted by the 6th Respondent, All India Council for Technical Education (AICTE) in Proceedings F.No. South-Central/1-46269194863/2026/EOA,Corrigend um-1, dated 14-05-2026, in continuing to display the old intake capacity in the APPOLYCET admissions portal without reflecting the enhanced intake and additional courses approved by the AICTE as arbitrary, illegal, unreasonable, without jurisdiction, violative of Articles 14 and 19(1)(g) of the Constitution of India and contrary to the provisions of the AICTE Act, 1987 and consequently direct the Respondents to permit the Petitioner's Institution to take admissions in full intake capacity and all courses as approved by the AICTE for the Academic Year 2026-2027, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to pass an interim direction directing Respondent Nos.2 to 5 to forthwith reflect and display in the ongoing APPOLYCET-2026 admissions web portal the enhanced intake capacity and additional courses (Artificial Intelligence and Machine Learning - 60 seats and Civil Engineering- 30 seats as approved by the 6th Respondent All India Council for Technical Education (AICTE) in Proceedings F.No. South-Central/1-46269194863/2026/EOA,Corrigend um-1, dated 14-05-2026 along with EWS seats by permitting the Petitioner's 3 Institution to take admissions in these courses in full intake approved by the 6th Respondent, pending disposal of the Writ Petition, and pass Counsel for the Petitioner: 1. The grievance of the petitioner in the instant writ petition is against the action of the respondent Nos.1 to 5 in failing to implement the statutory approvals granted by the 6th respondent - All India Council For Technical Education (AICTE) proceedings dated 14.05.2026 of extension of approval and in continuing to display the old intake capacity in the APPOLYCET admissions portal of "APPOLYCET" without reflecting the increase in the sanctioned intake and additional courses approved by AICTE. 3. When the matter has been taken up for consideration today, both the learned counsel submitted that the issue involved in the present Writ Petition is squarely covered by the earlier decision of this court in W.P.No.17767 of 2026 dated 03-07-2026, wherein it was held that: 4 “7. Having regard to contentions, since the issue relates to the admission of students to colleges for which the counseling is underway, this Court deems it appropriate to dispose of the writ petition, directing the respondents to pass appropriate orders for extension of approval sought by the petitioner within one (1) week from the date of the receipt of the order. 8. With the above directions, the writ petition is disposed of. There shall be no order as to costs.” 4. Following the above order, this Writ Petition is disposed of, directing the respondents to pass appropriate orders for extension of approval sought by the petitioner within one (1) week from the date of the receipt of the order. There shall be no order as to costs. 5. Registry is directed to append a copy of the order passed by this court in W.P.No.17767 of 2026 dated 03-07-2026 to this order.
