ORDER 27-04-2026 Heard Mr. N. J. Dutta, learned counsel for the petitioner and Mr. P. Borthakur, learned Addl. PP, Assam.
2. This is an application under Section 482 BNSS, 2023 praying for grant of
Page No.# 2/3 pre-arrest bail to the accused/petitioner, namely, Shofiqul Islam who is apprehending arrest in connection with Bijni P.S. Case No. 142/2025 under Sections 303(2)/318(3)/318(4) of BNS, 2023.
3. Case diary received. Perused the same.
4. It is submitted by Mr. Dutta, learned counsel that the in pursuance of the
order dated 25.02.2026, the petitioner already appeared before the I.O., cooperated with the investigation of the case and his statement was also recorded under Section 180 BNSS.
5. Mr. Dutta, learned counsel further submitted that the petitioner is no way involved in the alleged offence. However, he is still ready and willing to extend his cooperation, if needed during the investigation of the case.
6. Mr. Borthakur, learned APP submitted that the investigation is still under process and the present petitioner had appeared before the I.O. and his statement is recorded. However, from the note of the I.O. it is seen that he has not produced the Bank Passbook which was asked to produce during the interrogation.
7. Considering the submissions made by the learned counsel for the parties, materials available in the case diary, this Court is of the opinion that custodial interrogation of the petitioner may not be necessary for the purpose of investigation of the case. However, the petitioner is directed to cooperate with the I.O. of the case and to produce the relevant documents if any for the purpose of investigation.
8. In view of this, the interim bail granted to the present petitioner vide order dated 25.02.2026 is hereby made absolute on the same terms and conditions.
9. With the above observation and direction, this pre-arrest bail application
