Side) for R1 to R4 ORDER The prayer in the Criminal Original Petition is to transfer the investigation in Crime No.244 of 2024 pending before the 4th respondent Police to any other competent investigating Officer and to take action in accordance with law. 2. Upon perusing the complaint, the case of the complainant is that by forging orders in the name of a 3rd party Company, the accused had caused the complainant to supply goods and thereafter, did not make the payment. When the complainant Company verified the place of business, it was closed. The accused made false statement as if he was involved in an accident. After verification of the address of the said person and also with the Company named in the order, they found that the Company had got nothing to do with the accused and the accused had actually created false documents and cheated the complainant. Hence, the complaint. 3. It is even stated that the seal is forged. Under the said circumstances, the FIR came to be registered on 07.06.2024. The grievance of the learned counsel for the petitioner is that absolutely no action has been taken and the lethargy is on account of extraneous reasons.

4. Upon query made by this Court, it is also admitted by the learned Government Advocate (Crl. Side) that the anticipatory bail petition was also dismissed. Though two years have gone by, investigation has not proceeded further. 5. Considering the same, the petitioner has made out a case for transfer of investigation. Accordingly, this Criminal Original Petition is ordered on the following terms:- i) Crime No.244 of 2024 is transferred from the file of the 3rd respondent / Inspector of Police (Crime), J3, Guindy Police Station, Chennai to the file of the Inspector of Police, Crime Branch CID, Egmore, Chennai. ii) The 3rd respondent shall handover the entire CD file within seven (7) days from the date of receipt of the web copy of the order and the due orders in this regard shall also be passed by the 1st respondent / Commissioner of Police. iii) Now the matter is transferred to Crime Branch CID, Egmore, the investigation shall be completed as expeditiously as possible, in any event, not later than six months from the date of receipt of the web copy of the order. 08-07-2026 Neutral Citation: No KKN https://www.mhc.tn.gov.in/judis
