Rakesh Kainthla, Judge The petitioners have filed the present petition for quashing of FIR No. 61 of 2024, dated 23.10.2024, registered at Police Station Shillai, District Sirmour, H.P., for the commission of offences punishable under Sections 126(2), 115(2), 117(2), 333, 351(2), and 352 read with Section 3(5) of the Bhartiya Nyaya Sanhita, 2023 (BNS) and consequential proceedings arising out 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2026:HHC:14778 of the said FIR based on the compromise effected between the parties. 2. It has been asserted that the parties have amicably settled the matter with the intervention of the respectable persons of the society. No fruitful purpose would be served by continuing the proceedings. Hence, the petition. 3. Statement of the informant/victim Anil was recorded on 9.3.2026, in which he stated that he had entered into a compromise with the accused voluntarily without any influence from any person. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The offences punishable under Sections 126(2), 115(2), 117(2), 352 and 351(2) of BNS are compoundable under Section 359 of Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS). Section 359(3) of BNS provides that when an offence punishable under this Section is compoundable, and the accused is liable under Section 3(5) of the BNS, the offence may be compounded. Therefore, the offences punishable under Sections 126(2), 115(2), 117(2), 351(2) and 352 read with Section 3(5) of BNS are
3 2026:HHC:14778 compoundable. Section 333 of BNS corresponds to Section 452 of IPC. The court had quashed the FIR for the commission of an offence punishable under Section 452 of IPC in Chaman Lal versus State of H.P. Latest HLJ 2023 (HP) (1) 213, Avinash Singh Rana versus State of H.P. 2023 STPL 3181, Ameen versus State of H.P and others 2023 (1) Him. L.R. 375, Prashant Dharmani and others versus State of H.P. and others 2023 (1) Him. L.R. 241.
These judgments are binding on this Court. 6. In view of these binding precedents, the present petition is allowed and the FIR No. 61 of 2024, dated 23.10.2024, registered at Police Station Shillai, District Sirmour, H.P., for the commission of offences punishable under Sections 126(2), 115(2), 117(2), 333, 351(2), and 352 read with Section 3(5) of BNS and the consequential proceedings arising out of the FIR are ordered to be quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8.
