1. Petitioner seeks anticipatory bail. 2. Learned Senior Advocate appearing for the petitioner submits that, the petitioner is falsely implicated in the instant case. He submits that, the petitioner belongs to a particular political party. It is by reason of such political affiliation that the police case was started. He refers to the merits of the matter and submits that the allegation as against the petitioner is that, the petitioner allegedly held out threats for withdrawal of a police complaint. He points out that, on the date the alleged threat is said to be made, the petitioner was in custody. 2
3. State is represented. 4. Learned Advocate appearing for the State opposes the prayer for anticipatory bail. 5. Considering the materials in the case diary and considering the fact that there is an issue of false implication, I deem it appropriate to grant anticipatory bail to the petitioner. 6.
Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioner will report before the Investigating Officer once he is out of custody once a month till the conclusion of the investigation and on condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 7. The prayer for anticipatory bail of the petitioner is allowed. 8. C.R.M. (A) 3485 of 2026 is disposed of. (Debangsu Basak, J.)
