08.10.2026 16 Court No. 05 (DL) (Suvendu Mukherjee) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (APPELLATE SIDE) WPA 26695 of 2026 Sankar Chakraborty –Versus – The State of West Bengal & Ors. Mr. Subhendu Das ….for the petitioner Mr. Sankar Prasad Dalapati, Ld. AGP Mr. Raj Mohan Chattoraj Ms. Meghna Sarkar …for the State respondents Mr. Shahjahan Hossain Ms. Sanjida Sultana Mr. Souvik Shaw …for the respondent nos. 7-9 1) Affidavit of service filed on behalf of petitioner is taken on record. 2) By presenting this writ petition, petitioner prays for direction upon concerned police authorities to take steps which would permit petitioner to enjoy peaceful possession over property in question. It is alleged that private respondents have forcibly driven petitioner out of said property and narrating same complaint was lodged on 7th September, 2026 before concerned police authority. 3) State respondents are represented by Mr. Dalapati, learned Additional Government Pleader who has 2 submitted that issue involved in this writ petition is civil in nature. 4) Learned advocate representing respondent nos. 7 to 9 has disputed submission made on behalf of petitioner regarding title of the property in question and claim is laid on behalf of private respondents over same. 5) From respective submissions made on behalf of parties, it appears that there is longstanding property dispute and private respondents are claiming title of property in question. Hence, parties are required to approach civil court. Police authority is not the appropriate authority to decide inter se right of parties over property in question. 6) Hence, writ petition is not entertained and same stands dismissed. 7) However, this order shall not preclude petitioner to take steps in accordance with law, if so advised. 8) Parties to act on server copy of this order duly downloaded from the official website of this Court.
