It is submitted that the Petitioner and the Respondents have had a series of meetings and deliberations during the pendency of the Petition and have arrived at a mutually acceptable resolution pursuant to which, the Petitioner has, by its letter dated 06.01.2026, conveyed its permission to commerce and construct the Underground Drainage (UGD) works through the Mantri Tranquil Drainage (UGD) works through the Mantri Tranquil Apartment premises subject to certain terms and conditions as were mutually discussed and agreed between the Petitioner and the Respondents. Copy of the Letter dated 06.01.2026 is annexed to this memo as Document No.1 for the kind perusal of this Hon'ble Court. 4. The Petitioner does not wish to pursue the present Writ Petition in view of the recent development and Commitment/Assurance by the Respondents. - 4 - HC-KAR NC: 2026:KHC:5655 WP No.14995/2024 WHEREFORE, it is respectfully prayed that this Hon'ble Court may be pleased to dismiss the present petition as withdrawn with liberty to pursue/initiate action if the Respondents do no adhere/honour their commitment and assurances made to the Petitioner in the interest of Justice and Equity." The memo reads that the petitioner and the respondents, after a series of meetings, have amicably resolved the dispute. As such, the petition stands dismissed as withdrawn. It is needless to observe that the petitioner will be at liberty to approach the civil Court if any failure to act in terms of the resolution subject to all just exceptions.
