In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Krishnaganj Police Station case no. 255 of 2026 dated 08.06.2026 under Sections 21(c) of the NDPS Act. And In the matter of : Swapan Pal
……Petitioner. Mr. Prabir Majumder Mr. Snehanshu Majumder Ms. Anindita Kundu
......for the Petitioner. Mr. Rajendra Banerjee, Ld, APP Mr. Surendra Belal Ms. Sharmistha Das
……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody since 21.06.2026, although, there was recovery of 770 bottles of wincrex cough syrup but no recovery was effected from the present petitioner. Learned advocate appearing for the State opposes the prayer for bail as in the initial FIR petitioner was named as a person who fled away from the spot. There are no incriminating materials appearing against the present petitioner relating to further recovery and so far as the antecedent is concerned the same is a case under Sections 448/323/354/34 of the Indian Penal Code which is not in respect of the violation of the provision of NDPS Act. 2 Having considered the same, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Swapan Pal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Special Court. Thus, CRM (NDPS) No. 2086 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Compliance report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
