BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER Date : 27.04.2026 Heard Mr. M. Hossain, learned counsel for the applicant. Also heard Mr. C.K.S. Baruah, learned counsel appearing for the respondents No. 1 and 2 and Mr. K.A. Sodial, learned counsel appearing on behalf of Mr. S.K. Talukdar, learned Standing Counsel, Cooperation Department appearing for the respondents No. 3 and 5. Page No.# 3/3 By filing this miscellaneous application, the applicant prays for setting aside the order dated 20.02.2026 passed in WP(C) 4817/2022, whereby, the writ petition was dismissed for non-prosecution. It is submitted that earlier the case was represented by Mr. Subhash Mohan Sharma and Mr. J.C. Choudhury, learned counsel. Mr. Subhash Mohan Sharma has not been attended the Court since last several months prior to the dismissal and Mr. J.C. Choudhoury another counsel being an elderly person, was unable to attend the Court on the previous date i.e., on 17.02.2020 as well as on the date of dismissal on 20.02.2026 as he was sick.
Under the circumstances, the petitioner has engaged the present counsel to represent his case and prays for recalling the impugned order dated 20.02.2026. The learned counsel for the respondent has no objection if the writ petition is restored. Considering the grounds shown and in the interest of justice, the order dated 20.02.2026 whereby, the writ petition 4817/2022 was dismissed for non-prosecution is set aside. The writ petition is restored to its original file and number. With the above observation, the Misc Case stands allowed and disposed of. List the matter after 3 (three) weeks for admission.
