WP No. 26409 of 2026 __________ Page2 of 4 Order (Order of the Court was made by Dr.G.Jayachandran J.) (1) Mr.E.C.Ramesh, learned Standing counsel accepts notice on behalf of the 1st respondent. Since no adverse order is passed against the 2nd respondent, notice to the 2nd respondent is dispensed with. (2) By consent, the main writ petition is taken up for final disposal at the admission stage itself. (3) The notice issued by the 1st respondent, for putting up a temporary shed in the terrace and an additional gate in the second floor, which is contrary to the Building Plan Approval, is under challenge in this writ petition. (4) The learned counsel for the petitioner states that the Apartment Association, for the convenience of the flat owners, has put up additional gate in the second floor and a temporary shed for drying cloth in the terrace and hence, clauses 7 and 8 of the impugned notice dated 29.05.2026, is to be quashed. (5) The learned counsel appearing for the 1st respondent/Corporation submitted that the additional gate and the temporary shed was put up for the exclusive use of the petitioner herein, and is found to be in contradiction and violation of the Building Plan Permission and hence, notice has been issued for removal of the same. He would further submit that since the petitioner failed to remove it, the Corporation authorities have already removed the offending construction.
