2. According to the petitioner, the permit granted in favour of the fifth respondent is in violation of G.O.Ms.No.198, Home (Transport-I) Department, dated 28.04.2025. The said Government Order was issued in exercise of the powers conferred under Section 68(5) of the Motor Vehicles Act, 1988 (hereinafter referred to as the “MV Act”). 3. Section 90 of the MV Act provides for a remedy of revision.
It empowers the State Transport Appellate Tribunal, on an application made to it, to call for the records of any case in which an order has been passed by a State Transport Authority or a Regional Transport Authority against which no appeal lies. If the Tribunal is satisfied that such order is improper or illegal, it may pass such order as it deems fit, and every such order shall be final. 4. In the present case, the petitioner has approached this Court without exhausting the efficacious statutory remedy of revision available under Section 90 of the MV Act. 5. W.P.No.3850 of 2026 Transport Appellate Tribunal within a period of four weeks from the date of receipt of a copy of this order. If such revision is filed within the stipulated period, the State Transport Appellate Tribunal shall entertain and decide the same on its own merits, without rejecting it on the ground of limitation. All the rights and contentions of the parties are left open. 6. Consequently, the connected miscellaneous petition is closed.
