The petitioner is aggrieved by an order dated December 7, 2024, passed by the learned Civil Judge (Senior Division), 3rd Court, Howrah in Money Suit No.66 of 2023. By the order impugned, the learned court rejected an application for addition of a company allegedly of which the defendant nos. 1 and 2 are the directors. The court was of the view that the suit was filed for recovery of money from the defendant nos. 1 and 2 and the company which is a separate identity is distinct from its directors and hence was not a necessary party to the suit. I do not find any illegality and/or irregularity in the order impugned. The assets of the directors are separate
2 from the assets of the company. Thus, the suit has been framed for recovery of money that was given by the petitioner to the predecessor-in-interest of the defendants. Under such circumstances, the revisional application is dismissed. However, the petitioner will be at liberty to avail of any other protection that may be available in law. There shall be no order as to costs. Parties are to act on the server copy of this order.
