08.10.2026 DL/30 Ct. No. 758 Mujahid, A.R.(Ct.) In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side Case No. WPA 29848 of 2024 In the matter of : Chhabi Bhowmik … Petitioner VS. The State of West Bengal & Ors. … Respondents For the petitioner : Mr. Arindam Sen Mr. Saurav Basu Mr. Sumit Biswas Ms. Payel Maji … Advocate For the Respondents / State : Mrs. Sudiapa Banerjee Ms. Subhamita Ghosh … Advocate For the Private Respondent : Mr. Bratin Kumar Dey Mr. Joydeep Das … Advocate 1. The present writ petition has been filed by the petitioner, who is an accused in Lake P.S. Case No. 230 of 2024 dated 6th December, 2024 under Sections 329(4)/305/3(5) of BNS, 2023. 2. The petitioner in the present writ petition has contended that the police authorities are harassing him. The petitioner has further prayed that the Lake Police Station must take appropriate steps against the Investigating Officer in connection with the Lake P.S. Case No. 230 of 2024 dated 6th December, 2024. Page 2 of 3 3. A report was called for from the State. 4. The concerned police station has filed the report stating that the matter has been thoroughly investigated and the Charge-Sheet No. 171 dated 29th November, 2025 has already been submitted before the Court of learned Chief Judicial Magistrate, Alipore, South 24 Parganas. 5. Learned advocate for the petitioner submits that since the investigation is complete and the matter is now before the learned trial court, the instant writ petition may be disposed of by granting liberty to the petitioner to defend the said proceedings in accordance with law. 6. In view of the aforesaid submissions and considering the status report submitted by the State, this Court is not inclined to pass any orders, as prayed for in the present writ petition. There is no material placed on record to persuade this court to pass such drastic order against the Investigating Officer of the case. This Court, therefore, disposes of this writ petition without any orders, as prayed for. 7. This court, however, clarifies that this court has not gone into the merits of the allegations made by the petitioner and the defence of the petitioner in the present case case. 8. Accordingly, WPA 29848 of 2025 is disposed of without any order as to costs. Page 3 of 3 9.
