Petitioner is before this Court seeking for the following reliefs: “a) Issue a writ or order or direction in the nature of mandamus directing the 3rd Respondent to issue e-khata certificate to the house property of petitioner built on site No.14 and 15 carved in Sy.No.28 of Ulavalli Village, Sringeri Taluk, by considering the representation of petitioner vide - 3 - HC-KAR NC: 2026:KHC:2888 WP No. 12430 of 2020 Annexure-B dated 24.10.2019 and Legal notice dated 04.03.2020 vide Annexure-E and Representation dated 13.03.2020 vide Annexure-G and also directions contained in letter dated 18.11.2019, 4.12.2019 and 20.03.2020 vide Annexures-C, D, and F respectively forthwith in accordance with law. b) Pass any other suitable order/s or direction as this Hon'ble Court may deems fit to pass in the facts and circumstances, in the interest of justice.” 2. The father of the petitioner was granted a residential house site formed in Sy.No.128 of Ulavalli village, Sringeri Taluk, Chickmagaluru District, as per Order No.53/86-87 and SC No.4546/88-89 measuring 35 x 40 feet. Though a house had been constructed, the said house collapsed. Thereafter, no construction could be put up on expiry of the father and mother of the petitioner. The petitioner made an application for mutation of his name in the panchayath records and issuance of E-Khata. The same having not been considered and Khata has not been issued, the petitioner submitted various representations to the - 4 - HC-KAR NC: 2026:KHC:2888 WP No. 12430 of 2020 respondents at Annexure-B dated 24.10.2019, Annexure-E dated 4.3.2020 and Annexures-G dated 13.3.2020 etc. Those representations also not having been considered, the petitioner is before this Court seeking for the aforesaid reliefs. 3. Whenever any application for change / transfer of Khata is made, it is required to consider and necessary orders to be passed within 30 days as per the Karnataka Sakala Services Act, 2011. In the present matter, the application has been filed in the year 2019 and thereafter, various representations were submitted and the matter has been pending for last six years for issuance of Khata. In that view of the matter, I pass the following: ORDER i. Petition is allowed. - 5 - HC-KAR NC: 2026:KHC:2888 WP No. 12430 of 2020 ii. Respondent No.3 is directed to consider the representations of the petitioner at Annexure-B dated 24.10.2019, Annexure-E dated 4.3.2020 and Annexure-G dated 13.3.2020 and pass necessary orders within a period of 30 days from the date of receipt of copy of this order.
