Hence, the case. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. The petitioner is in custody from the year 2024. This is third bail application filed by the petitioner. He is in judicial custody for more than two years, but no trial is progressing. He is ready to co-operate with the trial. Hence, he prayed bail for the petitioner. 4. The learned Counsel appearing for the State reiterated the prosecution case and reported that since A3 has been absconded, trial could not be completed. The entire quantity was recovered while the petitioner was transporting and trafficking the ganja. The petitioner's earlier applications have been dismissed by this Court twice. There is no change of circumstances to grant bail to the petitioner. He opposed the grant of bail to the petitioner. 5. Crl.O.P.(MD)No.12667 of 2026 records. 6. I have gone through the earlier order passed by this Court in two occasions, wherein the case was considered on merits and found that the findings have been rendered and the petitioner was actively participated in this occurrence. Hence, this Court is not inclined to grant bail to the petitioner. Though it is stated that the petitioner is in incarceration for nearly two years, since one of the co-accused absconded, the trial could not be completed. Considering the fact that since one of the co-accused is still absconding, though this Court is not inclined to grant bail to the petitioner, there shall be a direction to the trial Court to speed up the trial process and complete the same at the earliest. If necessary, the trial Court may split up the case in respect of the absconded accused and proceed with the trial. 7.
With the above said directions, this criminal original petition stands dismissed. (K R S J)
