No.3760 of 2026 ORDER This writ petition is filed seeking to issue a Writ of Mandamus directing the 1 to 6 respondents to enforce the order of the third respondent vide proceedings in Na.Ka.A4/2378/2025 dated 25.03.2026 and to take appropriate action as against the 7th and 8th respondents for the illegal development made by them as against the above order of the third respondent by considering the petitioner's representation dated 30.06.2026. 2. The learned counsel for the petitioner submitted that civil suit is pending with respect to the subject property of the petitioner in O.S.No. 210 of 2025 on the file of the learned Principal District Judge at Sivagangai and by an order dated 30.03.2026 temporary injunction is also granted, against the defendants of the aforesaid suit which is filed by the petitioner herein. Later, the injunction order was violated, pursuant to which, the petitioner had filed a writ petition in WP(MD)No.87 of 2026 before this Court seeking direction to invoke proceedings under Section 144 of Cr.P.C., in which an order was passed by this Court giving appropriate directions to the authorities concerned. No.3760 of 2026 respondent had conducted a discreet enquiry and by proceedings in Na.Ka.A4/2378/2025 dated 25.03.2026 restraining both the petitioner as well as the rival parties, ie., the defendants in O.S.No.201 of 2025, from enjoying the subject property till the disposal of the civil suit pending. Violating the same, the private respondents herein have entered forcibly into the subject property and are erecting another Solar plant. 3. The learned Government Advocate submitted that despite the proceeding passed by the third respondent, restraining both the parties from enjoying the said property, the respondents 7 and 8 have violated the same. 4. The learned Government Advocate appearing for the respondents 4 to 6 submitted that the complaint lodged by the petitioner is received and enquiry is pending. 5. In view of the same, the 6th respondent police is directed to put the petitioner as well as the 7th and 8th respondents on notice under Section 64 BNSS and the petitioner is directed to produce all the necessary documents, particularly the injunction order passed by the civil court, and also the proceedings of the Tahsildar. The respondent police is directed to forthwith stop the ongoing solar plant installation in the subject property. 7. With the above said directions, this Writ Petition is disposed of.
