Sl. No.43 08.10.2026 BP Ct. 237
CRR 4390 of 2026
Jyotsna Majumder @ Jyotshna Majumder Vs. The State of West Bengal and Ors.
Mr. Debapriya Majumder Mr. Chiranjit Pal
..for the petitioner
It appears that, by an order dated July 28, 2026, the learned Judicial Magistrate, 5th Court, Barrackpore, rejected an application filed by the prosecution under Section 311 of the Code of Criminal Procedure, 1973. Challenging the said order, Criminal Revision No. 348 of 2026 was filed. It further appears that, by an order dated September 22, 2026, the learned Additional Sessions Judge, 2nd Court, Barrackpore fixed December 21, 2026 as the next date of hearing of the revisional application. The learned advocate appearing for the petitioner submits that the next date fixed for trial before the learned Judicial Magistrate is October 12, 2026. It is submitted that, unless Criminal Revision No. 348 of 2026 is disposed of expeditiously, the petitioner, who is the de facto complainant, would be seriously prejudiced in the course of the trial. In view of the aforesaid, I do not find any necessity to keep the present application pending. Accordingly, CRR 4390 of 2026 stands disposed of with a direction upon the learned Additional Sessions Judge, 2nd Court,
2 Barrackpore, to dispose of Criminal Revision No. 348 of 2026, which is pending before him, preferably within a period of four months from the date of communication of this order. The proceedings before the learned Trial Court shall remain stayed for a period of five months from date or until the disposal of the revisional application pending before the learned Additional Sessions Judge, 2nd Court, Barrackpore, whichever is earlier.
