It is further submitted that the petitioner has failed to file undertaking affidavit before the respondent Police that he will not indulge in any further offence in future and he will be available till the disposal of the appeal proceedings. 3. Since the petitioner has failed to file an undertaking affidavit before the respondent police, this Court is not inclined to entertain this petition.
