This is an application u/s 5 of the Limitation Act, 1963, filed by the applicant praying for condonation of delay of 25 days in preferring the appeal against the judgment and award dated 09.07.2025, passed by the learned Member, MACT, Goalpara, in MAC Case No.317/2022 awarding a sum of Rs.11,40,361/- along with 7% interest per annum. It is submitted by the applicant/appellant that after receipt of certified copy of the judgment, the dealing Advocate sought for a legal opinion from a Senior Panel of Advocate and received the opinion on 20.08.2025. The Company then had to communicate with the main office for approval. After the formalities and after obtaining a legal opinion in the month of September, 2025, the appeal was filed resulting in a delay of 25 days. Learned counsel, Mr. M. Talukdar, is present for the respondent no.1/claimant and has raised no objection. Learned counsel, Mr. H.A. Ahmed is present for the respondent nos.2 and 3 and has raised no objection. I have considered the submissions at the Bar. Page No.# 5/5 Sufficient grounds have been shown. No malafide is discernible. Thereby, delay of 25 days is condoned. The Registry is directed to register the connected appeal. The names of Mr. M. Talukdar and Mr. H.A Ahmed to be reflected in the cause-list while registering the appeal.
