Learned advocate for the petitioner submits that petitioner has been implicated in a case for alleged recovery of 322 Gms. of Brown Sugar and is in custody for more than 1 year 6 months. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the order passed in CRM (NDPS) 892 of 2025 wherein direction was passed to conclude at least 6 witnesses by 15th of February, 2026. Having regard to the period not having been completed, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 97 of 2026 is dismissed. 2 Learned advocate for the State would communicate this order along with the order passed in CRM (NDPS) 892 of 2025 to the learned Judge, Special Court, ADJ, 3rd Court (under NDPS Act), Malda within a week from date. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
