Writ of Mandamus has been instituted to direct the Respondents 1 to 4 to remove the encroachment by demolishing the building put up by the Respondents 9 to 18 in Survey No. 292/36 and 292/40, Semmiyamangalam Village, Polur Taluk, Thiruvannamalai District 606 904 as per Notice dated 26/06/2025 issued by the 3rd Respondent and proceedings in Na.Ka. No. 1234/2024/va.A3 dated 22/08/2025 issued by the 4th respondent and direct the Respondents 1 to 4 to restore and maintain the Government Poramboke Survey Number 292/40 as Pathway within a time fixed by this Hon’ble Court. 2. Learned counsel for the petitioner would submit that enforcement action was initiated and notice was issued to the encroachers. That apart, the Block Development Officer addressed a letter to the competent authority seeking their assistance for removal of encroachments. 3. That being the stage under which the present writ petition is filed, the official respondents are directed to proceed with the enforcement action, if the https://www.mhc.tn.gov.in/judis WP No. 50333 of 2025 _______ Page5 of 7 encroachments have already been identified. 4. It is made clear that the competent authority alone shall exercise powers for removal of encroachments by affording an opportunity to the alleged encroachers and by following the procedures as contemplated under the relevant statutes and rules in force. The said exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order. 5. With the above directions, the Writ Petition is disposed of.
