PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.1 for granting of pre-arrest bail in connection with Crime No.147 of 2026, dated 09.04.2026 of Alipiri Urban Police Station, Tirupathi District, registered for the alleged offence punishable under Sections 309(4) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. On perusal of the record, the Petitioner is arrayed as Accused No.1 in this case. There are specific overt acts attributed against the Petitioner. The de-facto complainant has alleged that the Petitioner and Accused No.2 came near the car in which the complainant was sitting, knocked on the door, and asked him to unlock it. As soon as the complainant unlocked the door, the Petitioner and Accused No.2 forcibly entered the car, snatched the car keys from the complainant, and pushed him out of the vehicle. The Petitioner then handed over the keys to Accused No.2, and both of them drove away in the car. 4. The learned counsel for the Petitioner submits that the de-facto complainant is the owner of the Ford Endeavour car bearing registration No.AP 39 ER 0777. He further submits that Accused No.1 subsequently returned the keys of the car to the complainant. It is also submitted that 3 Accused No.2 has already been enlarged on bail by the learned IV Additional Judicial Magistrate of First Class, Tirupati, in Crime No.147 of 2026, in Crl.M.P.No.789 of 2026, vide order dated 27.04.2026. 5. The present petition has been filed seeking grant of anticipatory bail to the Petitioner/Accused No.1. There are specific overt acts attributed against the Petitioner for the alleged offences punishable under Sections 309(4) and 351(2) of ‘the BNS’. 6. In view of the specific accusation attributed against the Petitioner, this Court is not inclined to grant pre-arrest bail to the Petitioner, as it would amount to giving a shield, or protection or license to the Petitioner, who is alleged to have dispossessed the de-facto complainant of his vehicle by forcibly entering, snatching the keys, and driving away, as per the judgments of the Hon’ble Apex Court in Gurbaksh Singh Sibbia v. State of Panjab1 and Sushila Aggarwal v. State of (NCT of Delhi)2. Hence, this Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
