…...... 03 /23.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 305 and 331(3) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. There is an allegation that theft has been committed by unknown persons in the house of the informant from where cash and jewellery has been stolen. Co-accused were arrested and they divulge the name of this petitioner to be the person who had divulge the information about running of the business of the informant from his house. It is also alleged that the petitioner also received 10 grams of gold in view of divulging the said information. Admittedly from the confessional statement of the co-accused it transpires that the petitioner was not the party to the crime. The other co-accused have been granted bail by the coordinate Bench of this Court in BA No. 2038 of 2026, BA No. 979 of 2026 and B.A. No. 1274 of 2026. 2026:JHHC:8069

5. The petitioner is in custody since 01.11.2025. Charge has already been framed against the petitioner. 6. Considering the aforesaid fact that the other co-accused has been granted bail, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Hazaribagh in connection with Keredari PS Case No. 160 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand. 7. Accordingly, this bail application is allowed.
