The complainant has filed the present complaint alleging willful disobedience of the order dated 14.02.2025, whereby the management of Sumathi Vidya Samsthe, Tipaturu, Tumakuru, which was arrayed as respondent No.4 in the writ petition, was directed to consider the complainant's request for payment of subsistence allowance and take an action to pay the same till final order is passed in the pending enquiry. 2. The accused has filed an affidavit stating that she had resigned as the Secretary of the said institution on 12.02.2025, - 3 - HC-KAR NC: 2026:KHC:2208-DB CCC No. 474 of 2025 which is prior to the date of the order, the disobedience of which is alleged. The complainant has contested the said affidavit contending that the resignation of the accused is stated to have been accepted on 30.06.2025 and therefore the accused should be treated as having continued as the Secretary of the said Institution till the said date. 3. We are not persuaded to accept the said contention. Since the accused has resigned from the said Institution on 12.02.2025, notwithstanding the delay in accepting her resignation, she was not in a position to implement the order. 4. The present complaint is closed. 5. However, this would not preclude the complainant from filing fresh proceedings against the persons in the Management of Sumathi Vidya Samsthe, Tipaturu, Tumakuru during the relevant period.
