Page No.1 of 6 https://www.mhc.tn.gov.in/judis W.P(MD)No.3730 of 2026 For Petitioner : Mr.K.A.S.Prabhu For Respondents : Mr.D.Venkatesh Counsel for State of Tamilnadu (Crl.Side) O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The writ petition is filed seeking a direction to the 1st respondent to grant six days of emergency leave, without police escort, to the petitioner's father, namely Nachimuthu @ Mayavan, S/o.Palanisamy, aged about 44 years, a life convict, PID No.85873, confined at the Central Prison, Trichy, for attending to the serious illness of his mother, namely Mrs.Pattammal, aged about 63 years, on the basis of the petitioner's representation, dated 05/07/2026. 2.The learned counsel appearing for the petitioner would submit that the petitioner's father is a life convict and that the petitioner had sent a representation, on 05/07/2026 seeking emergency leave for her father to attend to the illness of his mother, who is affected by a stroke and has been admitted as an inpatient at Jaisee Hospital, Madurai. Page No.2 of 6 https://www.mhc.tn.gov.in/judis W.P(MD)No.3730 of 2026 3.The learned counsel for the State of Tamil Nadu (Criminal Side), on instructions from the respondents, would submit that it is a fact that the mother of the convict prisoner has been admitted to Jaisee Hospital, Madurai, for treatment of a stroke. 4.Taking into consideration the facts and circumstances of this case, we are inclined to grant emergency leave to the convict prisoner for six days without escort, on the following conditions:- (i).The convict prisoner, namely Nachimuthu @ Mayavan, S/o. Palanisamy, now detained in the Central Prison, Trichy, is granted emergency leave for six days from 15/07/2026 to 20/07/2026. (ii).The convict prisoner shall be released from the Central Prison, Trichy, at 05.00 p.m. on 14/07/2026 upon him executing his own bond for Rs.10,000/- before the Superintendent, Central Prison, Trichy and he shall return to the prison at 10.00 a.m. On 21/07/2026. Colony Police Station, Madurai, daily at 06.30 p.m. from 15/07/2026 without fail. (iv).During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual. 5.With the above directions, the writ petition stands allowed. No costs.
