This is the second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 143/2024 registered at Police Station – Kunda, District – Kabirdham (C.G.) for the offence punishable under Sections 331(4), 305(A) and 3(5) of the BNS. 2. Earlier the first bail application of the applicant was rejected by this Court vide order dated 24.04.2025 passed in MCRC No. 3132/2025, on merits. 3. Case of the prosecution, in brief, is that Case of the prosecution, in brief, is that the complainant has lodged a report at the Police Stations concerned alleging inter-alia that some unknown persons have committed crime of theft of money in cash, gold and silver ornaments from his house, during the course of investigation, the RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 applicant was taken into custody and on his memorandum, the stolen articles were seized and he was found to be involved in other similar offences, hence, different crime numbers were registered against him at different Police Stations. Hence, this application. 4. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It has been submitted that out of 13 witnesses, 07 witnesses were examined before learned trial Court and all of them had not stated anything against the applicant. It is submitted that the applicant is in jail since 07.08.2024, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 5. Learned counsel appearing for the State/non-applicant opposes the bail application of the applicant and submits that the applicant along with the co-accused is said to have committed a crime of theft from the house of the complainant, and besides the present case, there are 3 more criminal cases registered against him for which he has preferred bail applications bearing MCRC Nos. 2392/2026, 2377/2026 and 2369/2026, which have been listed today. It is also submitted that the bail application of the co-accused has been rejected by this Court vide orders dated 26.11.2024 and 03.12.2024 passed in MCRC Nos. 8180/2024 and 7896/2024, therefore, he is not entitled for grant of regular bail. 6. I have heard learned counsel for the parties and perused the case diary. 3 7. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant along with the co- accused is said to have committed a crime of theft from the house of the complainant, and besides the present case, there are 3 more criminal cases registered against him for which he has preferred bail applications bearing MCRC Nos.2392/2026, 2377/2026 and 2369/2026, which have been listed and being rejected today, moreover, the bail application of the co-accused has been rejected by this Court vide orders dated 26.11.2024 and 03.12.2024 passed in MCRC Nos. 8180/2024 and 7896/2024, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 8. Accordingly, this second bail application of applicant – Sagar Patre involved in Crime No. 143/2024 registered at Police Station – Kunda, District – Kabirdham (C.G.) for the offence punishable under Sections 331(4), 305(A) and 3(5) of the BNS, is rejected at this stage. 9. Needless to say that the trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously. 10.
