This is an application under Section 482 of the BNSS, 2023 whereby the petitioner, Syed Tanzim Alam @ Syed Tanzim Alom is seeking Anticipatory Bail apprehending arrest in connection with an FIR, which is registered as Badarpur Police Station case No. 48/2025 registered under Sections 61(2)/318(4)/316(2)/316(5) of the BNS, 2023 read with Sections 21(1)/21(2)/21(3) of the Banning of Unregulated Schemes Act, 2019.
3. It is submitted by the learned Addl. P.P that the case diary as called for has not been received and therefore the learned Addl. P.P submits that the case dairy may be awaited as it is not known whether the petitioner has appeared before the Investigating officer pursuant to the interim order passed by this Court.
4. On the other hand, learned counsel for the petitioner has submitted that the petitioner has duly appeared before the Investigating Officer and his statement is also been recorded.
7. Considering the fact that the other co-accused persons have been granted the privilege of pre-arrest bail, I see no reason to keep the matter pending for receipt of the case dairy as the Investigating officer has failed to produce the same today. Accordingly, the prayer for pre-arrest bail is allowed.
8. The order of interim pre-arrest bail dated 19.02.2026 is hereby made absolute.
9. It is further provided that the petitioner shall continue to co-operate with
Page No.# 3/3 the investigation and make himself available before the Investigating Officer as and when called for and shall not try to influence the witnesses in any manner or hamper or temper with the evidences.
10. The Anticipatory Bail petition, is accordingly stands disposed of.
